“Boat Rental Terms and Conditions”

1. A security deposit is required, then refunded after inspection when the boat is returned to the port. We will check the overall condition of the boat, the inventory and any damages. It can take up to 8 working days to have the security deposit unblocked on your credit card, but normally this is done within 2/3 days depending on your bank.
2. If a boat is returned after the agreed time, a penalty of 50 euros per hour will be applied, no matter how many minutes have lapsed into each extra hour.
3. The renter must return the boat in good order and condition, agree to leave the boat free of occupants and all personal belongings, and return the boat to the owner.
4. The renter is responsible for any damages, defects and harm to the boat, as well as for the loss of any of its parts during rental. In any such instances the renter will pay the respective amounts as explained during the training briefing.
5. The area of navigation is limited to 2 miles (3,7km) from the coastline. The maximum allowed speed in the harbour is limited to 3 knots/h (5,5km/h) and if exceeded, can lead to a fine payable by the Renter. In such instances, the Renter also loses his/her deposit.
6. The renter is obliged to follow the route of navigation provided by the owner at the day of rental. If the renter doesn’t abide by this rule, the owner will keep the full deposit.
7. The renter is obliged not to exceed the approved maximum capacity of people on board.
8. The boat owner is not responsible for thefts and burglaries that may happen to the property of the renter and/or passengers on the boat during the time of rent.
9. In the event of an accident or any health event happening to the renter, and/or other passengers on the boat, the owner is not held responsible.
10. It is not allowed to leave the boat unattended on the open coast. The renter must ensure there is always someone responsible on board. This person must be able to act competently in case of any unforeseen events.
11. If the weather conditions are bad and not adequate to perform the journey safely, the owner reserves the right to refuse the boat rental. In such case any kind of prepayment will be fully returned to the renter.
12. All accidents or breakdowns involving third parties must be notified immediately to the owner. The boat is insured against accidents and liability with the limitations stated in the general and specific conditions of the policy.
13. The renter gives the right to use his/her credit card to compensate any fines sent to the owner which were incurred during rental by any of the renter’s crew members.
14. In case of any damage created by any of the renter’s crew members where the cost would exceed the deposit, and where the insurance company refuses to compensate the cost of damage, the difference will be compensated by the renter.
15. If the renter decides to come back earlier than the agreed time, the owner will keep full charter rate.
16. This agreement is subject to Spanish Law. In order to resolve any doubt or difference of opinion between the parties regarding the compliance or interpretation of the terms of this agreement, both parties agree that they submit to the jurisdiction of the Tribunals of Palma de Mallorca and the higher authorities, waiving their own jurisdiction in case they have another one.
17. Training and briefings are not counted into the time of your rental period however the renter should arrive at least 30 minutes prior to the booked time for a training and safety briefing. The boat must be returned promptly at the agreed time as it will be needed for the next customer. Evening returns must be back 15 minutes before sunset.
18. Rental times: 10:00-14:00 or 10:00-18:00 (arrive 09:30 or earlier) or, 15:00-19:00 (Arrive 14:30).
19. If the renter cancels the reservation at least 10 days before the pick-up, the total amount of the pre-payment will be refunded. If the renter cancels less than 10 days before the charter, no refund will be made. If the renter decides to end the rental before the agreed time, the unused hours will not be refunded.
20. Deposit is non-refundable unless the company cancels the reservation due to bad sea conditions, this is when the full deposit will be refunded.
