Age Requirement: Must be 25 years of age or older, MUST BE PRESENT AT ALL TIMES, AND MUST BE EITHER THE PERSON, OR SPOUSE OF THE PERSON, WHOSE NAME APPEARS ON THE CREDIT CARD AND MUST BE THE PERSON THAT SIGNS THE RENTAL AGREEMENT.
-Refusal of Service: Hidden Key Properties, LLC reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, or handicap. Due to liability issues, Hidden Key Properties will be unable to provide prospective renters with directions or keys to preview properties.
-Rate Changes: Rates subject to change without notice.
-Payment Details: A payment of 50% of the total booking is required when booking a reservation up to thirty (30) days prior to check in date. The remaining balance is due no later than thirty (30) days prior to your check-in date. Reservations placed within thirty (30) days of check-in date will require payment in full at the time of booking the reservation and must be paid with credit cards only (unless other arrangements have been made between Agent and Guest). Upon confirmation of full payment, a booking confirmation letter will be sent to you via email. Hidden Key Properties accepts Check, Certified Funds, and Money Orders. Hidden Key Properties does not accept cash. Please reference reservation dates and rental property when sending checks. Hidden Key Properties DOES NOT ACCEPT PAYMENTS AT CHECK-IN!
-Reservation is secured when security deposit payment is deposited, and your payment of security deposit confirms your complete acceptance of rental conditions.
-Non-Payment of reservation balance will result in cancellation of reservation and forfeiture of any and all payments made, as well as security deposit.
-Cancellation Schedule: Cancellations, rescheduling, or changes must be submitted in writing and confirmed received by Hidden Key Properties more than thirty (30) days prior to check-in date in order to receive refund, less $50 administrative fee. However, if Guest(s) cancels less than thirty (30) days prior to their arrival date there will be NO REFUND. All payments are non-transferable to another date. Refunds will be given only if Hidden Key Properties can rebook said dates with another guest.
-Greater than 30 days: full refund, less a $50 administrative fee
-Less than 30 days: Forfeiture of payment, less security deposit
-Renter agrees to accept rental property upon arrival provided that it meets the basic description as seen on company website, and will not be entitled to a refund of rental proceeds or have any claim/recourse against owner/Hidden Key Properties, LLC.
-No Show, Early Departure/Late Arrival: Hidden Key Properties shall not be responsible for Guest's inability or choice to arrive late to premises, or to depart late from premises FOR ANY REASON. In parallel, Agents are not responsible if Guests choose or are required to depart early FOR ANY REASON, including if members of Guests party do not show up or leave on time. NO REFUNDS OR REBATES will be offered in conjunction with early or late arrivals or departures. HIDDEN KEY PROPERTIES, LLC HIGHLY RECOMMENDS PURCHASING TRAVEL INSURANCE TO PROTECT AGAINST UNFORSEEN CIRCUMSTANCES THAT COULD RESULT IN CANCELING YOUR TRAVEL PLANS.
Directions to Property: Directions will be sent via confirmation letter after Hidden Key Properties has received full payment, including security deposit along with signed signature page of Rental Agreement. If Guests choose to leave home without directions, Hidden Key Properties cannot be held responsible for Guests inability to find the property.
-Security Deposit: A refundable security deposit is required on all reservations within 72 hours of booking. Once your party has checked out and all is found in clean, undamaged condition, and nothing is found missing, then the security deposit is refunded. If payment is made by check, Hidden Key Properties will refund security deposit via check mailed to you. To avoid possible assessment against renter party of record, any observable damages or abnormal conditions found upon entry must be reported to Hidden Key Properties within 3 hours after entry. Deposit shall be refunded within seven (7) business days of departure, provided the following provisions are met: Prior to vacating property, renters are responsible for:
-No damage is done to house (inside or outside) or contents, beyond normal wear and tear.
-Beds should not be remade if used, instead, please leave all soiled towels and linens in tubs.
-All debris, rubbish, and discards are placed in refuse containers outside (see Property Instructions regarding trash removal) and soiled dishes are placed in dishwasher and cleaned.
-All keys are left in the lock box and house is left locked, including windows.
-All charges accrued during stay are paid prior to departure.
-No linens are lost or damaged.
-Linens: Hidden Key Properties shall provide initial supply of linens in each property that supports the maximum occupancy. Bed linens and bath towels are not changed during your stay. Linens are NOT to be taken for outside use (i.e. lake, river, pool, etc.). The initial supply of complimentary consumables is not replenished; however, housekeeping service and other cleaning arrangements during your stay are available for an additional charge. Contact Hidden Key Properties for details.
-Pets: Most homes allow pets with a $10/day/pet, non-refundable pet cleaning fee. Please search for pet friendly properties. Most homes limit pets to dogs only, however, some properties allow cats. Please contact Hidden Key Properties to ask about cat friendly homes. Pet Policy shall include:
-No Pets in hot tub (if applicable). Guests agree to pay no less than $100 cleaning fee if pet gets into the hot tub.
-Pets must be completely housebroken, well behaved, and pest free. Guests will be charged an extra cleaning fee if pests (for example, fleas) are found inside or outside of property.
-Guests will not use any linen on pets other than the pet towels provided by Guests.
-Pets are not allowed on furniture inside property.
-Guests agree to pay for any damages caused by pets.
-If pets have an accident in property, all clean up will be performed by the Guests. Guests will remove waste from grounds and deposit in appropriate container or on the exterior of property grounds. Guests agree that failure to comply with clean-ups of either inside or outside of cabin will result in an additional cleaning charge.
-Guests agree to be in full control of their pets at all times & take full responsibility for pets well being.
-Guests agree pet will not be left outside, on porches, or anywhere that barking will disturb neighbors.
-If any of these Pet Policy items are not met, Guests are in violation of this Agreement/Contract.
-Guests agree that by signing this Agreement/Contract, they are authorizing Hidden Key Properties to charge Guest¡¦s credit card on file for any damages sustained, or if paying by other payment method, Guests agree to pay any additional charges beyond Security Deposit.
Lost Keys: Lost keys will result in a $25 replacement charge per key and will be billed to the credit card on file.
Lock-Out: A lock-out of Guests from property will result in a $35 travel charge plus a $35/hr onsite labor fee during business hours(Monday-Friday, 9 a.m. until 5 p.m.) and $50 travel charge and $50/hr onsite for after hours to provide access to property. A lock-out after business hours may result in a locksmith being called and Guests credit card being charged accordingly.
Telephone: Telephone long distance calls from house land line must be charged to a personal calling card or credit card. Cell phone signal on premises cannot be guaranteed.
Furnishings: All homes are privately owned property furnished and equipped by its OWNER. As such, Hidden Key Properties cannot make any changes to the furnishings or equipment provided by the owner. If Guest requires special appliances or equipment, please bring them with you. Furnishings are subject to change without notice. Rearranging or moving of furniture is prohibited and will result in a fee of no less than $100 due to extra housekeeping services. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to Guest(s), the renter. Certain areas in each rental property are locked for the OWNERS personal storage and are not included in this rental.
Owner Entry: Owner/Hidden Key Properties may enter the premises as required for repairs/maintenance of emergency need.
MAINTENANCE, REPAIRS & REFUND: This Rental Agreement is a legally binding agreement between Guest(s), Hidden Key Properties, LLC, & Owner. Hidden Key Properties will make every effort to correct any problem that arises during your stay in a timely manner subject to the terms in this agreement. There will be no refunds or compensation for events out of Hidden Key Properties¡¦ control including but not limited to: Acts of God, Mother Nature, Inclement weather, acts of war or government agencies, road maintenance, gas shortages, power outages or water outages, construction or maintenance work in the vicinity, equipment failures, road conditions, proximity to other dwellings, economic conditions, political conditions, business closures and area event schedule changes. In case of a breakdown of any property equipment, guests shall notify Hidden Key Properties immediately to make the necessary repairs. Hidden Key Properties will make every effort to correct any problem that arises during stay in a timely manner however; Hidden Key Properties cannot guarantee against mechanical failure of house equipment. Should a repairperson make a call to repair or replace a unit that is found to be in working order and the problem was due to Guests oversight, neglect or misuse, Guests agree that the repair call costs may be taken from Guests security deposit. Hidden Key Properties cannot be held responsible for the failing of any other company due to said company¡¦s error or service interruption (i.e. electricity, water, gas, etc) However, Hidden Key Properties agrees to do all that is humanly possible to remedy any issue as quickly as possible.
OCCUPANCY: The maximum occupancy is stated in all accommodation descriptions. These limits are required by law and are for the safety and protection of occupants and Owners. Any child five years old and above is considered an occupant & must be included in the occupancy total. Rollaway beds, cots, inflatable mattresses &
sleeping bags or other temporary or portable sleeping device not specifically provided by the owner and intended for use to accommodate extra persons are prohibited.
-Additional Guests: Overnight stays at property or on grounds by more than maximum occupancy requires an extra charge of $10 /night/occupant. Failure to disclose the correct number of occupants will result in the additional charges + a penalty of $250. Additional payment due will be taken from security deposit.
-Alcohol/Drugs: No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed on rental properties. If Guests are arrested for underage drinking at rental properties or if Hidden Key Properties observe Guests under the legal age of twenty-one (21) drinking alcoholic beverages, Hidden Key Properties reserve the right to terminate this Agreement and evict Guests with no refund or rebate. Illegal drug use is strictly prohibited and prosecuted to the fullest extent of the law.
-Conduct: Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents by means of including but not limited to; parties, excessive speeding through neighborhoods, riding of ATV¡¦s or Off Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, BB/Pellet Guns, Paint Ball Guns, Potato Cannons, or Fireworks, or any other noise-inducing mechanisms. Hidden Key Properties reserves the right to terminate this Agreement and evict Guests with no refund or rebate. NOISE ORDINANCES MAY EXIST FOR SOME COMMUNITIES and guests are required to abide by such ordinances.
-Smoking: SMOKING IS NOT ALLOWED INSIDE PROPERTY. NO EXCEPTIONS! Guests agree to pay for odor abatement if smoke residue or evidence of smoking is found in or around the property, unless otherwise stated.
-Wildlife: NO REFUND OR REBATE will be offered in connection with any wildlife encounters.
-Termination/Substitutions: Hidden Key Properties strive to comply with all reservation requests for specific vacation properties. However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstances outside of Agent¡¦s control, Agents cannot absolutely guarantee a specific property. Hidden Key Properties reserves the right to change property unit assignment to a comparable property without liability within a reasonable time frame should rental property become unavailable. A comparable property will have similar or better value, accommodations, function, unit amenities, or size as determined by Hidden Key Properties. No Refunds will be offered when comparable properties are available. Should Guest decline the comparable property, Guests will have the option of rescheduling reservation dates for said property to other available dates at no charge. Guests may also select from any other available properties for their reservation dates and pay or receive a refund of the difference in the total cost, or may choose to receive a full refund under the parameters of this agreement.
-Fireplace: Gas and log fireplaces are seasonal and are operational from October 1st through April 30th. In gas log fireplaces, no items may be burned in fireplace. Guests agree to pay damages, if any item is burned in fireplace. Guests also agree to pay a $100 fee in the event that the gas fireplace is found to be left burning upon check out. Pilot light should remain on; however, fireplace should not be left burning unattended. In wood burning fireplaces, no item including but not limited to; charcoal, lava rocks, accelerants, etc., may be burned. Guests agree to pay damages, if any items, other than hardwood or duraflame logs are burned. Pine is not considered a hardwood. Guests further agree that no fire in any type fireplace or fire-pit will be left unattended. Firewood may be purchased at local grocery stores, Lowes, and convenient stores. Please contact Hidden Key Properties in advance for information regarding obtaining firewood prior to stay. FIRE-PITS ¡V If a property does not offer a fire-pit, guests will not make one, doing so is considered damages and the guest will be charged accordingly. Guests agree to not cut down trees for firewood; however, it is permissible to use free standing limbs and/or sticks found on property as a fire source.
-Hot Tub: Hot tubs are cleaned and chemically balanced prior to your arrival. Water may therefore be cool. Overuse or misuse of the hot tub may result in a chemical imbalance and could create unhealthy water. Please observe all rules posted. If the water should become cloudy or develop an odor, please contact Hidden Key Properties. Guests may not add any objects or chemicals to the hot tubs and agree to pay damages if hot tub has been compromised. Guests agree to pay an additional charge of $50 if Guests request an additional cleaning of hot tub during Guests¡¦ stay. Guests understand that hot tub usage is at their own risk and will not hold Hidden Key Properties or Property Owner responsible for any injury or illness. It is absolutely forbidden for children to be in the hot tub without a responsible adult and all guests must follow hot tub rules posted at cabin. Guests agree to pay no less than $75, if hot tub has been compromised in such a manner that results in cleaning services being delayed or excessive.
-Propane Grills: For properties with propane grills Guest agrees that charcoal will not be put in the grill, if charcoal is found to be present inside the grill, Hidden Key Properties is authorized to deduct $100 from Guest¡¦s security deposit for cleaning of grill/grill replacement. Please be sure to turn the tank off after each use.
-Items Left Behind: Hidden Key Properties is not responsible for any items Guests leave behind at property. Hidden Key Properties is authorized to charge a fee of $25 plus shipping costs for the return of any items Guests leaves behind at property.
-Gravel Roads: Some roads leading to rental properties are dirt and gravel and mountainous and are sometimes bumpy. Hidden Key Properties is not responsible for conditions of road, nor are responsible for damage to any vehicles.
-Inclement Weather Policy: Since weather is beyond the control of the owners/Hidden Key Properties, if you choose not to come or to checkout early due to inclement weather, you must understand that you will generally forfeit your rent. Many third party companies offer travel insurance that may cover a trip cancellation due to weather under certain conditions. Hidden Key Properties strongly encourages guests to obtain Travel Insurance for said reservation dates. In the event of inclement weather, Hidden Key Properties shall not be held liable for guests¡¦ inability to arrive or early departure from property.
VIOLATION OF AGREEMENT/CONTRACT ¡V Hidden Key Properties reserves the right to remove renter without refund, if any of the Agreement/Contract items are not met. A material breach of this Agreement by Guests, which, in the sole determination of the Agents, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION with NO REFUNDS OR REBATES. If the tenancy created hereunder is for 30 days or less, any expedited eviction procedures set forth in the applicable laws of the State of Georgia shall apply Guest(s) may be evicted under such procedures if Guest(s): (I) hold over in possession after Guest(s) tenancy has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (iii) have obtained possession of the Premises by fraud or misrepresentation; or (iv) fail to pay rent as required by this agreement. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.
-Disputes: This Agreement/Contract shall be governed by and interpreted in accordance with the laws of the State of Georgia and be treated as though it were executed in the County of Gilmer, State of Georgia. Any action relating to this Agreement/Contract shall be instituted and prosecuted only in the Gilmer County Superior Court, Georgia. Guests specifically consent to such jurisdiction and to extraterritorial service of process.
INDEMNIFICATION AND HOLD HARMLESS ¡V Guest acknowledges and understands that each and every guest or guardian is solely responsible for any property damage, accident, injury or loss sustained to any person while in-residence, and neither the Agent nor the owner accepts legal or financial responsibility. Guests, and guardians, assume all risk of injury or other loss resulting from a recreational activity and will hold the Agent and Owner harmless with respect hereto. Guests hereby agrees to indemnify and hold Hidden Key Properties, LLC,
employees, officers and/or the property owner harmless from any claims, including those of third parties, arising out of or in any way a result of the guests use of the premises or items therein.
